Software as a Service: Terms and Conditions

Please read these terms and conditions of use (the “Terms and Conditions”) carefully before purchasing or using PeriUrja Energy Private Limited’s products and services (“Products”) (“Company”). These Terms and Conditions govern your purchase of the company’s products (“you,” “your,” and “yourself”). Purchasing products from the company indicates that you have read, understood, accepted, and agreed to be bound by these terms and conditions. Thank you for your interest in our products. Regardless of anything to the contrary contained in any documents, including purchase orders, your purchase of the company’s products will be governed by the following terms:

1. The products are warranted for one year against any electronic or mechanical defects. If a defect occurs, the company will repair or replace the defective unit or parts with new or rebuilt materials at its discretion, without charging for either parts or labour. Replacement units and parts are warranted for the balance of the original warranty period. This warranty excludes installation or damage caused by accident, misuse, abuse, improper wiring, incorrect voltage, operating the unit contrary to the instructions in the user manual, or any product that has been opened, altered, or tampered with.
   
2. Except for the warranty provided in Clause 1, products are not returnable once delivered, and no return or refund request will be entertained by the company; instead, the product will be delivered to the location specified by you when placing the order.
3. If you choose installation service for a purchased product, you agree that the location for installation shall be cleared and ready for installation on or before the arrival of the Company’s representative, including having access to electricity, and the location for installation shall be frost-free. The installation location must be legally owned by the user. If any deficiencies in the installation location are discovered, the Company or a representative of the Company reserves the right to refuse to install the product.
4. PeriUrja products and materials are protected by intellectual property rights, which include copyrights, trade names, trademarks, service marks, and logos. PeriUrja either owns these rights or uses them under licence or with permission from the owner of such rights. The PeriUrja products’ design, style, look, appearance, graphics, pictures, images, articles, stories, and other content are all protected by intellectual property rights. Unless expressly permitted, you may not modify, copy, reproduce, republish, upload, post, transmit, or distribute any material or information on or downloaded from any of our PeriUrja products, including but not limited to text, graphics, video, messages, code, and/or software, by any means or in any manner, without our prior written permission.

They supersede any prior agreements or negotiations between you and the company regarding such subject matter. The Company shall not be liable to the other or be in default if and to the extent that the performance or delay in performance of any of its obligations under these Terms and Conditions is prevented, restricted, delayed, or interfered with due to circumstances beyond the reasonable control of the Company or any force majeure event.
